The present Terms and Conditions of Access ("Conditions of Access") regulate access and use of any person (the "User") to the pages included in the web domain http://www.ferfor.com (the "Web Page"), property of CONTRACT TRANSIT BARCELONA, S. L .L. ("CTB"), as well as the contents and services included therein.
Access to this Web Page or its navigation by the User imply necessarily and with no restrictions the acceptance and subjection to the Conditions of Access. It is therefore recommended that the User reads them carefully and in depth each time he/she want to enter CTB's Web Page.
CTB reserves the right to make, any time and without need of previous notice, any change or update of the contents and services, of the Conditions of Access, and in general, of any part of the design and configuration of its Web Page.

ACCESS TO THE WEB PAGE

The User enters the Web Page under its own responsibility. Its contents and services have the only purpose of spreading information concerning the activities carried out by CTB.

INTELLECTUAL AND INDUSTRIAL PROPERTY

Intellectual and industrial property royalties over the contents of the Web Page correspond in sole right to CTB, unless otherwise specified. Any use or exploitation other than the abovementioned requires previous written authorization from CTB. Specifically, the User is forbidden to reproduce, distribute, post (including staffing services), modify, collect and exploit in any other shape or form the contents included in the Web Page, without previous written authorization from CTB.

PERSONAL DATA PROTECTION

In order to use certain services on this Website, Users may be requested to provide certain personal information (hereafter referred to as, "Personal Data") to CTB. CTB shall add any Personal Data collected to a database wholly owned by them, and registered in the General Registry of the Spanish Data Protection Agency, according to the legislation in force and the stipulations of the General Data Protection Act 15/99, dated December 13th. Any such Personal Data shall be processed automatically for the following purposes:
Contact form: To process the User's query; CTB will contact the User through any of the channels chosen by him/her: postal mail, telephone, fax or email.
Newsletter subscription form: To send CTB's newsletter and/or any other communications regarding the services provided by CTB.
Marketing and promotional communications can only be sent to the User whenever he/she has ticked the corresponding box in the respective form, in accordance with the stipulations of Law 34/2002, dated July 11th, on E-Commerce and Information Society Services, and of the General Law on Telecommunications (Law 32/2003, dated November 3rd).
The User may at any time exercise his/her legal right to access, rectify, cancel or oppose any Personal Data recorded, in accordance with the stipulations of the General Data Protection Act 15/99 and Royal Decree 1720/2007, dated December 21st. The reliability of the User's data is essential to provide the appropriate service according to the purposes of the Website.
CTB have implemented the required security measures on their installations, systems and files, and treat all Personal Data confidentially, in accordance with the legislation in force and Royal Decree 1720/2007, dated December 21st, which developed the organic law on data protection. Moreover, CTB is considering implementing additional technical means and measures to further enhance security.
To this end, the User agrees to allow CTB to process his/her Personal Data for the aforementioned purposes, in accordance with Article 4 of the Organic Law on Data Protection and Article 10.4 of Royal Decree 1720/2007, dated December 21st.
Lastly, CTB agrees not to transfer any Personal Data included in their database to third parties without the User's consent, with the exception of those cases explicitly allowed by the data protection law.

USE OF COOKIES

CTB may use cookies on their Website to collect certain personal data such as the User's Internet browser and operating system, the IP address from which he/she is connected, and the time and date of the connection. Cookies enable CTB to produce anonymous statistics on the number of visits to the Website, the browser settings and other browsing data. The purpose of these statistics is to improve the content and structure of the Website.

LINKS

Any link, hypertext, in-depth link, framing, or any other type of virtual connection to the Web Page by means of telecom networks from any other web site or URL address ("Links"), must be duly authorized by CTB, and the link must always relate to the company's homepage.
CTB wishes to clarify that the Links to external web pages that the Web Page might contain answer solely to the purpose of orientating the User, by placing at his disposal other sources of information that might be of interest to him/her.
CTB regularly checks the contents offered through the Links. Nevertheless, it is impossible to know exactly and at any time which is the exact content of each link. For this reason, we kindly request users or third parties to inform us at ctb@ctbcn.eu, should they find Links that might be contrary to the law or morality, go against law and order, or that might incite to violence or discrimination on sexual, ideological, religious or racial grounds.
Apart from the legal stipulations, CTB declines any responsibility concerning the contents of the Links or the harms or errors that any virus activated by accessing those links or using them might cause to the User's computing systems (hardware or software).

CONTRACT TRANSIT BARCELONA, S. L .L., reserves the right to modify or discontinue any of its models without giving a prior notice.
The present WEB page has been designed according to our most current products. As part of our policy towards a continuous process for improvement of the products, CTB, reserves the right, to modify at any time, the specifications of the items described and displayed.
The colors and textures played through the computer screen or in your case through the printers could have significant differences from the real items.
Please, when in doubt of interpretation that may arise, consult with our sales department.

APPLICABLE LAW AND JURISDICTION

The present Terms and Conditions of Access are subjected to the Spanish Laws and jurisdiction.
Any disputes, disagreements or claims arising out of, or in connection to, the interpretation, execution, breach, resolution or cancellation of these Access Conditions, directly or indirectly, shall be submitted to Barcelona's Arbitration Court. The User and CTB herein agree to entrust the administration of the arbitration and the joint appointment of a sole arbitrator according to their Rules and Bylaws. The arbitration procedure shall be conducted in accordance with the Regulation of the aforementioned Court, to whom both the User and CTB submit their case; both parties expressly agree to fulfil any resolution or judgement that may be announced.
Furthermore, whenever required, the User and CTB, expressly waives any jurisdiction that may apply to them, and agree to submit to the Courts and Tribunals of Barcelona. Notwithstanding the foregoing, the User and CTB shall do everything in their power to resolve any disputes amicably.
